Terms and Conditions of the Tabirai Car Rental Reservation Service
Article 1 (Application and Definitions)
1.1 Application
1. These Terms and Conditions govern the rights and obligations between customers (hereinafter referred to as “User(s)”) who use the car rental reservation website “Tabirai Car Rental” (hereinafter referred to as “the Site”), operated by Pam Inc. (hereinafter referred to as “the Company”), to make car rental reservations, and the Company.
2. By using the Service, the User is deemed to have agreed to these Terms and Conditions.
1.2 Definitions
The definitions of terms used in these Terms and Conditions are as follows:
- ・“Service” means the car rental reservation service provided on the “Tabirai Car Rental” website operated by the Company.
- ・“Car Rental Company” or “Car Rental Companies” means a car rental company or companies that provide the car rental services available for reservation on the Site.
- ・“Cancellation Policy” means the cancellation and cancellation fee policy established by the Car Rental Company.
1.3 Relationship with Other Terms and Conditions
If there is any inconsistency between these Terms and Conditions and any other terms applicable between the User and the Company, these Terms and Conditions shall prevail, unless otherwise stipulated in such other terms.
Article 2 (Service Content and Contractual Relationships)
2.1 Description of Services
The Service provided by the Company includes the following:
- ・Provision of information on vehicles and rates offered by Car Rental Companies;
- ・Acceptance of reservation requests from Users;
- ・Handling of reservation confirmations, changes, and cancellations;
- ・Processing of payments (credit card payments); and
- ・Provision of other related information and support.
2.2 Contractual Relationship
1. When a reservation is made through the Service, a rental car service contract is concluded directly between the User and the Car Rental Company.
2. The Company is not a party to that rental car service contract and assumes no responsibility whatsoever in connection with the contract.
Article 3 (User Registration)
User registration is not required to use the Service. However, registered Users may access the following convenient functions:
- ・Viewing reservation history;
- ・Automatic input of personal information.
Article 4 (Conclusion of Contract)
4.1 Time of Contract Conclusion
1. The rental car service contract between the User and the Car Rental Company is concluded when the Car Rental Company accepts the User’s reservation request and a notification is sent to the User via the Site. Even if the User cannot receive such notification due to communication issues or incorrect contact details, the contract shall nevertheless be deemed concluded.
2. After the rental car service contract is concluded based on the preceding clause, the User shall be obliged to pay any cancellation fee in accordance with the applicable Cancellation Policy.
4.2 Failure to Conclude Contract
1. If the Car Rental Company does not accept a User’s reservation request, the notification is sent to the User via the Site that the rental car service contract has not been concluded.
2. If a reservation has already been paid for but the contract fails to conclude, the payment will be refunded.
Article 5 (Fees and Payment)
5.1 Fee Structure
・Basic Fee: Vehicle rental fee and Collision Damage Waiver fee
・Optional Fee: Additional insurance or equipment charges
5.2 Payment Method and Timing
・Payment Methods: On-site payment or advance credit card payment (Visa, Mastercard)
・Payment Timing:
o For on-site payment: made at the Car Rental Company’s office on the day of rental.
o For advance credit card payment: processed when the reservation is confirmed.
5.3 Additional Fees
Only the basic and optional fees listed under Article 5.1, which are displayed as the “total fee” at the time of reservation, are eligible for advance credit card payment. Any additional charges (e.g., for extra options added later or for extended rental periods) must be paid directly to the Car Rental Company on the rental day. Users are advised to confirm the details of the contract with the Car Rental Company regarding all applicable fees.
5.4 Use of Credit Card Payment
1. If a credit card company declines payment authorization, the User will not be able to use advance credit card payment. The Company shall not be liable for any resulting loss or damage.
2. Unauthorized use of credit cards or false information is strictly prohibited. In such cases, the Company may cancel the reservation, suspend the User’s access to the Service, and seek compensation for any damages suffered by the Company, the Car Rental Company, or third parties.
Article 6 (Cancellation of Reservation)
6.1 Method of Cancellation
1. Cancellations can be made via the Site.
2. Cancellations will be accepted up to one hour prior to the scheduled start time. However, cancellation fees may apply in accordance with the Cancellation Policy.
3. A cancellation takes effect once notification has been sent via the Site. Even if the User does not receive the notification due to communication issues or incorrect contact information, the cancellation shall still be valid. Users who do not receive a notification are encouraged to contact the Car Rental Company directly.
6.2 No-Show Cancellations
1. Users who are unable to use the reserved service must cancel the reservation in accordance with the procedures specified in the preceding article.
2. Failure to appear without notice on the scheduled rental day shall be treated as a no-show, and the User will be liable for the applicable cancellation fee in accordance with the Cancellation Policy.
6.3 Refunds
In the case of cancellations for reservations paid in advance by credit card, refunds will be made to the User’s credit card for the amount due after deducting any applicable cancellation fee in accordance with the Cancellation Policy. If a refund cannot be made to the original credit card, an alternative refund method may be used.
Article 7 (Terms of Use and Restrictions)
7.1 User Requirements
The Service is available only to individuals who:
- 1.Are at least 18 years old; and
- 2.Possess a valid driver’s license.
7.2 Restrictions on Use
Reservations may be declined in the following cases:
- 1.The User has a history of serious accidents or issues;
- 2.False information is provided; or
- 3.The Company or Car Rental Company deems the reservation inappropriate.
7.3 Elimination of Antisocial Forces
1. The User represents and warrants that they are not, and will not become, a member of any organized crime groups, a person for whom five years have not passed since ceasing to be a member of such groups, a quasi-constituent of organized crime groups, corporate extortionists, social movement racketeers, political movement racketeers, highly-sophisticated criminal syndicates, or any other person of a similar nature (hereinafter collectively referred to as "Antisocial Forces"), and that they do not, and will not in the future, fall under any of the following categories:
- ・Having any relationship with Antisocial Forces that is deemed to constitute an unjustified use of such forces, such as for the purpose of obtaining improper benefits for themselves or a third party, or causing harm to a third party.
- ・Having any relationship that is deemed to involve Antisocial Forces, such as providing funds or benefits to them.
- ・Having any socially reprehensible relationship with Antisocial Forces.
- ・Having any relationship recognized as engaging in transactions with Antisocial Forces or with companies or organizations related to such forces.
2. The User further agrees not to engage in, either directly or through a third party, any of the following acts:
- ・Violent or coercive demands;
- ・Unreasonable demands beyond legal responsibility;
- ・Threats or acts of violence in connection with transactions;
- ・Defamation or obstruction of business through spreading rumors or using deception or force; or
- ・Any other comparable acts.
3. If the User violates any one of the preceding 2 clauses, the Company may forfeit the benefit of the User's term of use and immediately terminate the User’s right to use the Site and the Service without notice, demand or any other procedure. The Company shall not be liable for any resulting damages.
Article 8 (Disclaimer)
The Company shall not be liable for any of the following:
- 1.The quality of vehicles or services provided by Car Rental Companies;
- 2.Any disputes between the User and the Car Rental Company;
- 3.Damages caused by vehicle malfunction or accidents; or
- 4.Inability to use due to natural disasters or other force majeure events.
Article 9 (Handling of Personal Information)
The Company will handle Users’ personal information in accordance with its “Privacy Policy”. By using the Service, the User agrees that their personal information may be shared with Car Rental Companies to the extent necessary for processing reservations.
Article 10 (Prohibited Acts)
10.1 Prohibited Acts
Users shall not engage in any of the following:
- 1.Providing false information;
- 2.Impersonating a third party to make a reservation;
- 3.Subleasing;
- 4.Making multiple reservations for the same date or otherwise causing inconvenience to others;
- 5.Violating laws, regulations, or public order and morals; or
- 6.Any other act deemed inappropriate by the Company.
10.2 Violations
If the User commits any prohibited act or other inappropriate behavior, the Company may suspend the User’s access to the Service or take other necessary measures.
Article 11 (Suspension or Termination of Service)
11.1 Temporary Suspension
The Company may temporarily suspend all or part of the Service in the following cases:
- 1.System maintenance;
- 2.System failure or malfunction;
- 3.Natural disasters or other force majeure events; or
- 4.Any other reason the Company deems necessary.
11.2 Termination of Service
The Company may terminate the Service with prior notice to Users.
Article 12 (Amendments)
The Company may revise these Terms and Conditions at any time. Revisions will take effect upon notification to Users or publication on the Site.
Article 13 (Governing Law and Jurisdiction)
1. These Terms and Conditions shall be governed by and construed in accordance with the laws of Japan.
2. The Naha District Court shall have exclusive jurisdiction as the court of first instance for any disputes arising in connection with the Service.
